Following the fundamental human rights enforcement suit filed by the President of Chocolate City Group, Audu Maikori, the court sitting presided over by Justice John Tsoho has ordered the Nigerian Police and the Kaduna state government to pay the sum of N40 million as compensation for his unlawful arrest and detention between February and March 2017.
Justice Tsoho who in its ruling also directed the duo of governor Nasir El-Rufai and the police to pay the sum of N1,430 to the applicant as the cost of instituting the suit noted that his judgement was not meant to interfere with the on-going trial of Makori in Kaduna, but state categorically that the police could justifiably arrest suspects for allegedly violating the law and order on the cyberspace.
Audu Maikori had on May 5, 2017 filed a fundamental human rights suit against the government of the Kaduna state and the Kaduna state police command on the allegations of posting inciting tweets alleging the killing of some Southern Kaduna students by Fulani herdsmen. The details of the tweets however, later turned out to be false, which made Maikori express regret over the posts and retracted them, claiming he obtained the information from his driver.
