The Assistant General of Police Zone 7 of the Nigeria Police Force had been restrained through a Court Order dated 25/11/2024 by Honourable Justice Kayode Agunloye of the FCT High Court pending the determination of the matter in the Suit No FCT/HC/M/532/2024.
Earlier in a correspondence dated November 20, 2024 to the Inspector General of Police Kayode Egbetokun, a Nigerian, Mr. Daramola Olutoye, the defendant and counter-claimant in the civil Suit Number CV/1646/17 in the FCT High Court in Maitama, Abuja, Nigeria, informed the President and Commander-in-Chief of Armed Forces of the Federal Republic of Nigeria, the Honourable Minister of Police Affairs, the Inspector General of Police, among others, of the need to restrain the Assistant Inspector General of Police of the Zone 7 of the Nigeria Police Force, Mr. Bernard Igwe, from contemptuously, unlawfully, prejudicially and unconstitutionally intervening in the pending Suit Number CV/1646/17.
The defendant and counter-claimant, stated that “I hereby place it on record that the Assistant Inspector General of police of the Zone 7 of the Nigeria Police Force is unlawfully and unconstitutionally usurping the roles of the Nigerian judiciary to ‘grant’ some of the reliefs sought by the claimant in the court, to wit: recovery of premises, detention of defendant, intimidation of defendant, providing security back up for the claimant, threatening legal tenant, among others; in spite of the pendency of the claims for judicial determination in the said suit. The AIG has unlawfully arrogated to himself the powers of the Nigerian judiciary as he is giving judgement and enforcing claims that are subjudice in the civil Suit Number CV/1646/17 in the FCT High Court 22 in Maitama, FCT-Abuja, Nigeria.”
He further said that “the illegal, unlawful and unconstitutional acts by the Assistant Inspector General of police of the Zone 7 of the Nigeria Police Force in Wuse Zone 3 Abuja, as well as other police officers in the same Zone 7, that are aimed at perverting and/or obstructing the course of justice are recently orchestrated in spite of the fact that the matter had been reassigned by the Chief Judge of the FCT High Court to another Judge in Court 22 of the FCT High Court in Maitama, FCT-Abuja after the Presiding Judge in the matter, Honourable Justice Adeniyi, was elevated to the Court of Appeal.”
He posited that “To that extent, and in consonance with Section 1(1)(2)(3) and Section 21(b)(i) of the Third Schedule Part I and the Fifth Schedule Part I code of Conduct for Public Officers (General) 9 and Item 13 Fifth Schedule Part I Code of Conduct for Public Officers of the Constitution of the Federal Republic of Nigeria 1999 (As Amended) and other extant and relevant Laws of the Federation of Nigeria.” defendant and counter-claimant requested that the Inspector General of Police should immediately direct the Assistant Inspector General of Police of the Zone 7 of the Nigeria Police Force in Wuse Zone 3 Abuja (and all other police officers accordingly) to desist completely from any forms of interventions and/or harassments and/or invitations with respect to the said Suit Number CV/1646/17, which is presently subjudice; and that the Inspector General of Police should also kindly inform the Assistant Inspector General of Police of the Zone 7 of the Nigeria Police Force in Wuse Zone 3 Abuja (and all other police officers accordingly) that their failure and/or refusal and/or negligence to immediately halt all their actions in the subjudice matter, including all forms of intimidations and threats of arrest and detention against himself, his representatives, counsel, staff, associates and other persons that may be acting on his behalf or under his instructions with respect to the pending suit.
